Welcome to Pod, a voice AI platform operated by Invezo Finance, Inc. doing business as Standard Code (“Pod,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our voice AI platform, website at https://callpod.ai, and related services (collectively, the “Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Pod provides software for creating AI agents that handle voice calls. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Services for your internal business use only. All rights not expressly granted are reserved by Pod.
You agree not to:
You retain all ownership rights in the content you submit via the Services (“User Content”). You grant Pod a non-exclusive, worldwide, royalty-free license to use, process, and store User Content as necessary to operate and provide the Services.
If you enable call recording or transcript storage, you acknowledge and agree that Pod will store this information until deleted by you or pursuant to a defined retention policy. You are responsible for complying with all laws related to call recording and consent.
We may collect and use anonymized, aggregated data for analytics, service improvement, and internal business purposes.
Pod may use third-party providers (e.g., for transcription or voice synthesis). You authorize us to transmit content to such providers solely for processing required to deliver the Services. We are not liable for acts or omissions of third parties.
Access to the Services may require payment as described at https://callpod.ai or in a signed order form. Fees are billed in advance or as usage occurs and are non-refundable, except as required by law.
We use third-party payment processors. By providing payment information, you authorize us and our processor to charge your payment method for all applicable fees.
You are responsible for all taxes, duties, and government assessments (excluding taxes based on our net income).
These Terms remain in effect until terminated. Either party may terminate with written notice if the other party materially breaches and does not cure within 30 days.
Upon termination, your right to use the Services ends, and we may delete your data after 30 days. We may retain anonymized usage data.
All intellectual property rights in the Services, including software, content, and trademarks, belong to Pod or its licensors. Feedback you submit may be used by us without restriction.
The services are provided “as is” without warranties of any kind. We disclaim all implied warranties, including merchantability and fitness for a particular purpose.
To the maximum extent permitted by law, our total liability for claims relating to the services is limited to the amount paid by you to us in the 12 months before the event giving rise to liability. We are not liable for indirect, incidental, or consequential damages.
Each party will protect the other party's non-public business information disclosed under this agreement using reasonable care and will use it only to fulfill its obligations under these Terms.
These Terms are governed by Delaware law. Any dispute will be resolved by binding arbitration under the rules of the American Arbitration Association, in Wilmington, Delaware, unless otherwise agreed.
With your prior written consent, we may identify you as a customer and use your name and logo for marketing purposes.
We may update these Terms from time to time. If we do, we will notify you by email or within the Services. Continued use constitutes acceptance.
These Terms are the entire agreement and supersede all prior agreements.
You may not assign these Terms without our written consent. We may assign them as part of a merger, sale, or other corporate reorganization.
